More than two, but it's still khalwat

Vice raid by 'officers' from residents' association allegedly leaves man with black eye

NOT AWARE: Mohd Yusuf said he was not told of any beatings

IF you think that you can’t be nabbed for khalwat (close proximity) just because you are found together with more than one other member of the opposite sex, think again.

Aqmal (not his real name) and four of his friends found this out the hard way when their durian-eating session at their condominium unit in Block F of Indah Condominium at Prima Damansara came to a halt when several men from the local residents’ association came knocking on their door.

He claimed that the men were not only aggressive and thuggish, but also hurled insults at him and his friends.

To compound his misery, two of the men also punched him three times, leaving him with a black eye.

But the worse part for Aqmal is not about whether he was beaten or not; it was that the men who knocked on his friends’ home did not even identify themselves.

“I had just sat down to watch a DVD while my friends (three female and a male) were preparing food, others were in their rooms and one was on the computer when there were loud knocks and rattling of the grilles,” said Aqmal.

When his female friend opened the door, the shouting men, numbering about eight to 10, barged in and demanded their identification.

“They were without tags or any identification and they wrote on exercise books; one even called my friend a prostitute for inviting over male friends,” said Aqmal, who said he followed their directions without complaint.

But when they were bringing him and his three friends (two males and a female, as the other female was apparently a Christian), out the door, one of them told Aqmal he acted like an American — to which he replied: Lebih kurang lah (maybe).

This prompted an immediate reaction.

BRUISED EYE: Aqmal showing his police report, his medical report and the bruise he alleged was caused by people from the raiding party

“That was when they got angry and one of them punched me twice on my left eye and another punched me once on my head,” said Aqmal, who said he did not fight back but blocked their attack — which left his arm scratched too.

Aqmal said he later had to drive himself and the “officers” to their operations room at Lestari apartment
where they “gave me a lecture and told me what I did was wrong” — but no khalwat charge was pressed.

Aqmal said he admitted that he may be wrong but he is not satisfied with how he was treated and questioned the authority of the men. He lodged a police report at 3am while another friend lodged a police report yesterday.

Meanwhile, when Malay Mail met the alleged assailants, the Lestari Apartment Residents’ Assocation president Mohd Yusuf Abdullah confirmed the “operation” but denied the beating.

“We had full authority as, after we received information of the suspected khalwat (close proximity), we linked with Jais (the Selangor Islamic Affairs Department) and informed the local mosque imam who was called to help in the raid by the Indah Condominium mosque chairman Raja Shaharin Sahar.

“We do not do such things without information or without authority,” said Mohd Yusuf.

He said they had actually been lenient and had allowed the four individuals to go after advising them.

“I was not informed nor I am not aware if they were hurt in any way. This can be witnessed by others,” Mohd Yusuf said.

He added that such operations were common and it was done to curb maksiat (immoral activities), which he claims could become a worrying trend in the neighbourhood.

Prima Damansara chairman and mufti Raja Shaharin Sahar, who had called for the inspection, said he went over to the operations room to advise the four individuals, but he said the beating was “beyond my knowledge”.

“They looked fine when I spoke to them and they went home after everything was resolved cordially,” said Raja Shaharin.

The laws of zina stipulates that if the accusation is false, the accuser will have to bear the consequence of being a false witness. It seems to me the khalwat laws allows anyone to bear false witness without any sort of penalty.

I think we don't know whose story is true here..the RA,the raid victim or the JAIS?

This is what I will do if it ever happen to me: 1. Ask for their authority card 2. If none, spray them with insecticides from behind the grill 3. Take their photos using my phone 4. Call the police and report kidnapping/robbery attempt in progress 5. Once the police arrives, open the grill and go to the police station for a report 6. Go back home, regardless of the outcome, feeling happy that I've done some justice to the public albeit a little small :)

The question is what are our Government doing to these so called people who think they have a right to take the law into their own hands ???!!! Thugs are allowed to run free and do as they please ! And there will be no repercussions ! It is about time these vigilantes live in the real world and realise Malaysia will soon be left behind as other countries overtake us..... and all they are concerned about is "catching people" ! Malaysia is going to be living in the dark ages if something is not done to focus on productivity and not on what other people are doing in their private lives.

I have a question to all Malaysians, 1Malaysian or not. Ever wonder why all these people are still doing what they are doing in spite of the public outrage? Why we still get news on major corruptions again and again? Why we still get news on crimes (whether by locals or immigrants) again and again? Why we still get news on abuses again and again? Why we still get news on idiotic comments made by power that be (our leaders) again and again? Because all of them know the chances of them being held responsible for their actions is almost nil. Who needs to think of the repercussions when there is no responsibility? I can almost guarantee in the end, our highly pious En Mohd Yusuf Abdullah will not be held responsible and WILL get away scot free. Beating someone is a capital offence. Will he be prosecuted, or will he be tolerated? I think we all know the answer. So long as the enforcement is selective, these modern day 'heroes' will flourish under the guise of righteousness. Sam

The 'authorities' are just jealous they were not invited to the food gathering. It will be fine if they were there even if it's a bigger group of people. I better cancel the invitation for dinner with Ali and his wife this weekend.

It is sad that such things can happen and in the name of an authority which is supposed to administer proper unbiased justice. Pointing fingers at the Resident's Association will not help as sadly enough they are not mature enough to handle ANY sort of religious authority in that manner. This is the way I see it: 1. JAIS or any other authority cannot be allowed to authorize anyone to dispense judgement or administer punishment even if the laws are breached. The RECOGNIZED LEGAL authority or body should be the only ones allowed to do so once a report has been made. Allowing a resident's committee to carry out an arrest constitutes an act of trespass and even worse encourages vigilantism and sets the stage for repeat acts. 2. Furthermore it makes a mockery of JAIS and the authorities - painting them as incompetent, confused, ineffective and irrelevant in todays society - which should not be the case. There is nothing wrong about the laws that have been set in place - rather it is the people who fail to administer those laws properly. If JAIS or any other policing body is not careful, they could be the 'casssubeli' of any unrest and discontent that results thereof. 3. Remember that this is a multi-racial society and that the majority of people are intelligent and patient - but patience has it's limits. In order for a country and it's society to grow, the GOVERNMENT must nurture an environment of trust and security internally before it can make it's mark on the world stage. Governments cannot hide what is going on anymore, they cannot really control the populace any longer, not in this time and age. A smart leadership will realize this and attempt to WIN the nation over by putting their money where their mouths are and taking strong and visible steps to work FOR the people (not the other way around). JAIS must be seen to be answerable to a higher authority and that higher authority must be seen to be answerable to a united government. Unfortunately this is only one case of how power is misused in our country. Leaders must take note of these comments and see the times for what it is. A wise leadership will recognize that comments such as mine is 'matter of fact' and, rather than be offended, should get off their high horses and do something about it - and it is well within their power to do so ... and the people will love them for it. I urge the leaders to make their mark - sure you can't get everything right, but a step in the right direction is a big step indeed.

Religion is a PERSONAL matter. When is the government going to take responsibility and take actions against these self-proclaim 'vigilantes'? This goes under BULLYING. Just because one believes in the religion doesn't mean he or she has the right to lash out at others who may not share the same views. These little groups and organisations should be made illegal if they are in anyway involved with activities such as raids and so on. How in the wide world can we expect our country to live as a multi cultural / religious country when religious radicals get to abuse their powers like that JUST BECAUSE they are Muslims? I am Muslim but this is exactly why the name of Islam is tainted.

This is a sad indictment of lack of respect for the individual and blatant disregard for civil liberties. It is thuggish behaviour more at home in a fascist state like those of Hitler's Germany, Mussolini's Italy and Franco's Spain, but more recently seen in Taliban controlled Afghanistan.

Beware of "over religionization". Abide by the constitutional rights of each individual. I thought 1Malaysia is supposed to put an end to this.

Enough is enough. Enough of lies Encik Yusuf. I might be not with them during the raid, but when I came over to the Balai Gerakan at Lestari Apartment and listened to all the "ceramah" you and your parties gave to 4 of them, I asked you why your "people" have to punch him? You said "sebab dia melawan bila orang nasihat" ... and I am NOT deaf!!!

Faith is supposed to make the believer stronger,"enlightened" in both MIND and SPIRIT by its teachings and how it will shape our lives for the better, but in this case (and many more before this) it has proven that we as a society are pretty much weak, angry and paranoid. Faith in one's religion doesn't seem to translate into loving and more importantly RESPECTING your fellow man. I think I shall stick to pets, for if we are not going to use the one gift of God that separates man from beast, then I shall put my FAITH in beasts, for at least they are true to their nature and does not DISCRIMINATE or JUDGE, something we have "conveniently" forgotten at the expense of needing to be RIGHT. Sad times.
