Prove abuse claims or pay up RM105 million, court orders

RUNAWAY royal Manohara Odelia has one week to engage a lawyer to help her prove that her husband Tengku Temenggong Kelantan Tengku Muhammad Fakhry is a “psycho” who raped her and cut her on the chest with a razor.

This will be the final chance for the 17-year-old former Indonesian teen model and her mother, Daisy
Fajarina, 44, to bring the “evil prince” to justice.

Problem is, no lawyer wants to defend them in the RM105 million defamation suit filed by Tengku Fakhry, 31.

The only legal firm that did initially has handed its notice of withdrawal to Manohara and Daisy, who are now in Indonesia.

The firm returned all relevant documents to them, citing the reasons for abandoning them as lack of  cooperation, difficulty in preparing the relevant documents to defend their case and no credible information.

The firm’s withdrawal was ascertained yesterday at a hearing in chambers by High Court senior assistant registrar Shazali Hidayat Shariff.

Shazali then ordered that both mother and daughter find new solicitors by Nov 5, failing which the High Court will award judgment in default to Tengku Fakhry.

That means Manohara and Daisy have to stump out a whopping RM105 million plus other charges.

The prince’s counsel, Mohd Haaziq Pillay, said: “We applied for a date to allow the defendants time to engage new lawyers to substantiate their allegations.

“To give justice to the defendants, we requested the court to give them until Nov 5 to appoint their lawyer.

“But this would be the final chance for them as my client would like to bring closure to this matter that has affected him badly.”

Haaziq said he hopes the controversial pair would return to Malaysia to face trial.

Manohara and Daisy are required under Syariah law to attend the two hearings coming up in the Kelantan Syariah Court. Under common law, they do not have to attend the hearings.

Tengku Fakhry, in the first suit in the Syariah court, seeks reconciliation with his wife and in the other, orders Daisy and Manohara to pay him more than RM1 million that he claims they owe him.

In the RM105 million suit filed on July 20, the prince is suing his wife and mother-in-law, claiming that they had falsely and maliciously defamed him in allegations they made at news conferences between April and June about Manohara being abused.

He is seeking RM35 million each in aggravated, exemplary and compensatory damages as well as costs, interest and other relief deemed fit by the court.

The pressure had been piling on Manohara and Daisy to prove their allegations, with even the Indonesian
Foreign Affairs Ministry offering to assist them to file a report with Malaysian police.

The ministry was also prepared to file the report on Manohara’s behalf provided she produced all the evidence.
Indonesian police have also advised Manohara to make a police report in Malaysia with the help of the Foreign Ministry.

However, they did not take up the offer, baffling even the Indonesian authorities that began to suspect something was amiss.

Daisy had also blamed the Malaysian and Indonesian governments of trying to cover up the alleged abuse.

Manohara, who holds the title Cik Puan Temenggong, has alleged rape, torture and imprisonment by Tengku Fakhry during their seven months of marriage. They were married on Aug 26 last year and lived in Istana Mahkota, Kubang Kerian, Kelantan.

Nine months after the marriage in May, Manohara suddenly returned to Indonesia without the permission or knowledge of her husband, who is the third son of the Sultan of Kelantan.

almost a year this drama has been dragging along and while it is interesting, let's hope the young couple will get together. if they can forgive each other, why can we the public, both in indonesia and malaysia, forgive them as well. lets pray.

Where on earth will Manohara get that RM105 million? This is just ridiculous particularly so since it was her mother Daisy who is the materialistic one. She messed up the daughter’s marriage which otherwise could have worked and is now leading her to bankruptcy. This is sure to anger the Indons and we cannot afford to have discord with our neighbours especially now when everything little thing seems to upset both countries.

I sincerely hope that TT will kiss and make up with the beautiful Mano. She's a real darling and I can imagine how TT misses her. Bottom line is Daisy has to hire a lawyer in Malaysia. This lawyer is obligated to monitor the progress of this case, and taking position as the spokesperson of Manohara’s family. If we refer to Marriage Law, Daisy cannot be blame for letting her daughter to marry Tengku Fakhry. The law determines minimal age for women who are going to get married, which is 16 year-old. But this law contradicts the Child Protection Law, because it says that 18 year-old juvenile is still classified as a child. There are certain laws in Indonesia which is contradict one to another. This Marriage Law becomes more complicated when the marrying couple comes from different countries. In this law, the groom and his bride have to follow regulation in their own countries. Since Manohara’s marriage was held in Malaysia, her family has to ensure whether the marriage is registered or reported to the Embassy of Republic of Indonesia or not.

Manohara has to get advocacy in her marriage. The absence of advocacy becomes the main cause of Manohara’s case. And the most responsible persons for this problem are her parents. Maybe Manohara’s parents have miscalculated in her marriage. The least Daisy can do now is to get her a lawyer and get to the bottom of things.

parents are the most influential persons in determining the under-aged marriage. A desire to gain higher social status is often considered as the reason of marriage. Many parents still pledge social status. Poor Manohara is paying for it. Isnt there a way out for her?

Are we becoming a nation with leaders who have no sense of human decency, I wonder. We seem to condone abuse of human rights and there is lack of human rights awareness among the Malaysian public. What we lack is the commitment from the authorities to safeguard and protect the human rights.
