Confrontation expected when former CEO and chairman meet

KUALA LUMPUR: The 25-year-old Maju Institute of Educational Development (MIED), the MIC’s education arm, will hold its first formal annual general meeting (AGM) involving all 33 life members next week — but, oddly, there will be four separate AGMs dating back to 2004 on that one day.

The four AGMs in one sitting, covering 2004, 2005, 2006 and 2007, has stunned MIED life members who describe the move as unlawful as such meetings should be held annually.

The members who received notices for the meetings were particularly concerned about the accounts that would be presented since the MIED is mired in financial irregularities. The first three meetings for 2004, 2005 and 2006 have only one agenda to pass the accounts while the 2007 meeting has five items on its agenda.

The meeting, on Dec 3 at MIC headquarters, is also expected to see a face-to-face confrontation between MIED chairman and MIC president Datuk Seri S. Samy Vellu and the institute’s former chief executive officer P. Chitrakala Vasu, both of whom have been involved in a vicious duel since early this year.

The row is expected following fresh allegations that Chitrakala, who is a life member of the MIED, had used names of dead people to siphon out millions of ringgit under the pretext of providing education loans.

It was also claimed that Chitrakala has interests in 13 companies from auto service to management of a national service camp. She was also alleged to have used MIED funds to buy a house in London and a luxury car.

Sources said Samy Vellu could not explain why the MIED accounts were not kept properly, audited and submitted when asked by a central working committee (CWC) member at its recent meeting. The MIC
leader has said some RM18 million MIED funds are missing.

The MIED hogged the CWC meeting with Samy Vellu allegedly hurling more accusations at Chitrakala, whose most recent action was a defamation suit against her mentor, his wife Indrani and Tamil Nesan.

Chitrakala, when contacted. said: "He (Samy Vellu) is entitled to say anything he likes to a group of people who are willing to listen to his tales without questioning him just as how he has been telling things about AIMST and MIED ownership.

"I have stated everything I need to say to the police and the court with documentary evidence. The truth is with them and it will prevail."

Sources said MIED founding member former MIC treasurergeneral Tan Sri M Mahalingam was also accused of financial mismanagement involving millions in the award of dentistry equipment to AIMST University at the CWC meeting.

While Chitrakala said she would be attending the meeting, Mahalingam is expected to stay away. The Malay Mail had reported last month that the 33 life members of MIED have not had a single official meeting since its incorporation 25 years ago. The life members currently comprise 25 members, seven trustees and the chairman Samy Vellu.

MIED life member S. A. Vigneswaran had said that the circular of resolutions were usually distributed to the members at the CWC meetings.

MIED leadership denied this saying all meetings were held during CWC meetings but were at a loss to explain the absence of those who were not CWC members.

Speculation over 5 new trustees aligned to party chief

KUALA LUMPUR: Three MIC stalwarts are expected to relinquish their positions on the eight-member MIED trustees board. They are founding member Tan Sri M. Mahalingam, Tan Sri G. Vadivello and Tan Sri K. Kumaran.

Sources said the number of trustees would be increased to 10, which means that apart from replacements of the three resigning trustees, there would be two additional members.

Speculation is the new trustees will be Datuk S. Veerasingam, Datuk Dr S. Subramaniam, Datuk M.  Saravanan, Datuk T. Rajagopalu and Datuk K.S. Balakrishnan.

The sources said the new trustees  are close aides of MIC chief Datuk Seri S. Samy Vellu and that their appointments again raised questions about the planned move to disassociate MIED from the MIC.

Public outrage surfaced last month over a reported move by Samy Vellu to “hijack” the entity — considered the jewel in the crown of the MIC — and place it under a foundation headed by him.

Samy Vellu had this month told the media that the MIED and MIC would remain as one while sources said he had said otherwise at the Central Working Committee (CWC)  meeting before the news conference.

“Despite an assurance by the party president that MIED will remain part of the MIC, this new development has raised fresh doubts,” said a source.

very well articulated article. i wasnt sure there was so much dirt in the MIED. i do pray to the almighty that the truth will prevail and all responsible will pay heavy punishment for robbing the rakyat. i must also say the people posting comments here obviously are a knowledgeable lot with so much information unavailable before being posted. thank you all.

How often we say don't simply accuse another, your back could not be clean. P.Chitrakala Vasu is in her element, all out to cut Samy Vellu to size and failing to do so, could possibly be dragged to court and other horrible circumstances. I know very little of Samy Vellu, never met him, and the only time I saw him in person was a few years back in a shopping complex in Ipoh, when Samy was wearing thin the beautiful tiles, walking up and down. It was the Christmas season and seeing a Minister, I enquired what is Samy up to. Christmas shopping I was told, but then to tell the truth is like telling the Paris report of Altantuya is a fairy tale. I only know Aesop fairy tales and let us keep it at that. This woman has enough venom to make Samy not sleep well. I can't blame Samy. For 14 years she did his bidding. Loyal, a complete devout to her boss she was for all intends and purpose, another one of the 630,000 members of MIC. I am fascinated by this number, just because it constitutes 1/3 of the Indian community or basically every 3rd person is an MIC member. I am not good at Maths so, forgive my enthusiasm at being a Maths expert.

Chitrakala Vasu is not that innocent as it was thought of at first. She portrayed herself as an innocent CEO of MIED,and apparently Samy Vellu was bent on destroying her. She was “my girl” of Samy Vellu, pampered, and paid RM18,000, to be the CEO. She was brave enough to accuse Samy Vellu, and when Samy Vellu hit back more unsavoury details are immerging. One is she has interests in 13 companies and in league with T.Mohan, the MIC Youth Chief, has been, to say the least, a successful business woman. One cannot forget, the help rendered by Samy Vellu, husband getting 2 distributors licence for car dealership at the behest of Mahathir, and even a loan of RM3 million. There is allegation of funds being diverted from MIED and Samy Vellu has called her a thief devoid of any morals. So is Madam that innocent. Only time will tell. In the meantime, i cant wait for the confrontation on Dec3.

Actually, Chitrakala, T Mohan and Vasu (Chitrakala’s husband) all of whom are partners in Suria Setia Capital Berhad. The company has acquired 50 acres of land in Sungkai, Perak for 3.5 million. Another Chitrakala’s company, Sillverline Sdn. Bhd has secured 9. 3 million loan from Affin Bank. Now you know where the money has gone. MIED statement of accounts for 2004, 2005, 2006 and 2007 were NOT submitted to the registrar of companies. now they want to race through the accounts. Somebody please focus.

did you know that Chithrakala is a partner in Suria Setia Capital Berhad (SSCB) and Silverline Sdn Bhd. She had invested RM3.5 mil in SSCB for a deal which later did not go through and she had taken back the money. It was only on Feb 5, Chithrakala informedher business partner and MIC youth leader t mohan that the RM3.5 mil which she had invested was loan from MIED and Datuk Seri S. Samy Vellu. She had not indicated where she had got the funds for the investments before. Says a lot doesnt it?

AIMST University, which began operations two years ago, is still operating on a temporary certificate of fitness (CF). It was given a temporary CF was because it had not followed its master plan of building a mosque and a temple. Officials are still in the midst of getting a CF. malay mail please investigate.

The desperate women Chitrakala joined the long list of Samy Vellu cronies who enjoyed power and after fall out cry foul. Chitrakala says, she is no monkey but a Chartered Accountant and MBA holder to deserve the high income of RM 18,000 for being MIED CEO. Yet she is being accused of hijacking RM 5.26 million MIED fund. 3.2 million was accused of transferred to her business partner T. Mohan, MIC youth leader and the rest was deposited in her children’s accounts which were frozen by the authorities and then later uplifted. Any monkey would have known better ways to stash the loot.

The MIED board of trustees had never sat for a meeting in the last 25 years of its establishment. MIED board members were dominated by high-profile MIC leaders.MIED is supposed to be in the hands of the trustees. Any changes must only be done by the trustees who should decide in its future. the 33 board members should know their responsibilities since they had also played a role in establishing the MIED. Don't waver from the objective of the establishment. MIED is an extension of a wing of MIC. They should be reminded that they owe their position to the people. They should protect the institute.

AGAIN, THE RM100 MILLION SURFACES! This time, it might be in the benefit of the Indian community. I am member of Maju Institute of Educational Development (MIED) which is a company limited by guarantee pursuant to Companies Act 1965. I received a copy of the Memorandum and Articles of Association of MIED on 27th March 2009 after I requested a copy from MIED’s Company Secretary through my solicitors on 5th March 2009. The following statement is made after due consultation with my Accountant and Solicitor. Any misuse of public funds, particularly when those monies that were given by government and public as government grants and donations intended to support a marginalized community, is unacceptable. The objective of the establishment of MIED as per Article 3 of the Memorandum of Association states, “to receive and administer funds for education, scientific and charitable purposes, all for the public welfare and for no other purposes and to this end: (a) to foster, develop and improve education of all kinds and in such manner as may, from time to time, be decided upon by the Institute including but without prejudice to the generality of this provision, the founding and maintaining of scholarships, provided that it does not contravene the provision of the Education of Law of Malaysia; (g) to assist, aid and give relief to the poor and needy who by reason of age, ill-health, misfortune or infirmity are wholly or in part unable to maintain themselves and their dependents by their own exertions and in particular widows and orphans, victims of fire, floods, famine, war or calamity and those in need of moral or social rehabilitation or welfare” (emphasis added). There are no other provisions as regards giving of any study loans. Any disbursements of money to the needy are ONLY by way of scholarship or grants. The reality of disbursements in MIED A total sum close to RM100million has been disbursed as study loans to almost 10,000 students with an accruing interest at the rate of 6% per annum. This interest is charged on an annual basis commencing from the 6th month after completion of the studies funded through MIED. From 2008, an additional interest of 2% per annum is charged from the time the loan is disbursed and the 6% upon completion of the course till the loan is settled. 1. MIED is not authorized to give any study loan but only scholarships under its own Memorandum of Association. 2. To give any loan, with interest, whether study loan or otherwise requires a money lending license without which it becomes illegal. Todate, MIED does not have any money lending license. Therefore, all monies collected with interest is illegal. 3. All monies collected with interests are taxable. Failing to pay tax is another breach of the law and failing to declare the interest as an income is evading tax and illegal. 4. In an Institution such as MIED, a Section 24 company under the Companies Act 1965 which has acquired a Tax Exemption status, it must disburse all funds received for its intended purposes (like donations and grants) within 18 months. Failing to do so, the income is deemed taxable and if the monies are placed in Fixed Deposits (like the millions collected as government grants and donations were and are kept) as in the case of MIED, becomes taxable. Failing to declare and pay tax on such accrued gains are again illegal. 5. MIED has and is violating its own Memorandum and the Malaysian Law. Dato Seri S. Samy Vellu, MIED Board of Trustees, MIED’s Company Secretary and MIED’s Auditors should take responsibility for these unacceptable acts and omissions, where not a single members meeting was held except for signatures collected during the MIC’s Central Working Committee (CWC) Meetings since the inception of MIED in 1984. Prior to January 2009, MIED’s Board last met in 2003. SA Vigneswaran

Samy Vellu's statement that forensic accounting experts did a thorough job of tracing the trail of the missing RM18 million was a new disclosure. This is because he had previously stated that MIC's probe into missing funds and files revealed the disappearance of RM5.2 million. Will anyone question this when looking through the accounts? what a joke that so much money is missing and they are running through the accounts of four years in one sitting? isnt this illegal?

Protect MIED. Protect our assets. The meeting should be focused and not run through four years of matters in one sitting. the board should make a declaration that MIED belongs to MIC;MIED will always be part of MIC; The relationship between MIC and MIED will be perpetual.; no individuals or MIC leader (including the president) own MIED or AIMST University; None of the MIED trustees are owners of the MIED and AIMST University; the question of hijacking MIED and AIMST University does not arise.

There are 2 versions on the relationship between the MIC and MIED) from Samy vellu. Version One coming from the cwc meeting indicates MIED — that operates the Asian Institute of Medicine, Science and Technology (AIMST), the nation’s first private university — does not belong to the MIC. The second, a media statement, issued after the meeting says “the ownership between the MIC and MIED will be a perpetual relationship and will be a part of the MIC”. Now, party leaders are asking for the contents of the media statement to be recorded and reflected in the minutes of the CWC meeting and party records to avoid future false representations and misinterpretations by anyone in the future. I dare any of the trustees to move for a resolution to have this recorded!
