Rubber glove thieves lose conviction appeal

SHAH ALAM: Two men convicted for stealing rubber gloves more than three years ago had their appeal against their conviction turned down at the Shah Alam High Court this morning.

G. Krishnamorthy, 38, of Sungai Pelek, Sepang, and M. Anthony Kumar, 31, of Negeri Sembilan, were sentenced at the Klang Sessions Court by judge Noradibah Ahmad on July 26, 2006, to four years' jail for stealing 148 cartons of rubber gloves worth RM10,500.

The offence was committed at the Apollo Rubber Sdn Bhd factory in Kampung Olak Lempit, Banting, Kuala Langat, on Oct 23, 2000, at 1.15am. The duo had with them two machetes, three hammers and two wooden sticks when committing the offence.

Following their arrest on the same day, they were charged under Section 396/397 of the Penal Code on Nov 21, 2000.

They are appealing against their conviction as they felt that the Sessions judge had not been fair in giving consideration to their defence.

This morning, High Court judge Datuk Mohd Zaki Md Yasin said he found no reason to "disturb the judgment" and retained the same punishment of four years' jail.

However, he granted a stay of execution pending appeal by the convicts' defence counsel.

He also granted bail on the same terms as the Sessions Court and set bail at RM12,500.

Krishnamorthy was represented by S. Selvam while Anthony was represented by S. Sundarajan. Hazril Harun prosecuted.
