Commissioner for Oaths helped 'fix' accounts

... and admits Samy Vellu did not sign documents in his presence

KUALA LUMPUR: A Commissioner for Oaths here has been implicated in the alleged backdating of the annual accounts of the billion-ringgit Maju Institute for Education Developmen (MIED), the MIC’s troubled education arm.

He is alleged to have attested that MIED chairman and MIC president Datuk Seri S. Samy Vellu signed two statutory declarations on the MIED financial statements for 2004 and 2005 before him on Oct 15, 2008, and again on Dec 17, of the same year.

Sources said the commissioner admitted to the Malaysian Anti-Corruption Commission (MACC), which was acting on a report by former MIED chief executive P. Chitrakala Vasu, that Samy Vellu did not endorse the statutory declaration in his presence.

The Malay Mail learnt that Samy Vellu was on Oct 15 that year attending the inaugural convocation of AIMST University in Semeling, Kedah, while his whereabouts on Dec 17 were not known.

This was also confirmed by MIED trustee Tan Sri M. Mahalingam, who in a letter to company secretary Riteq Services Sdn Bhd and the MIED, said all trustees and Samy Vellu were in Semeling on Oct 15 for the convocation.

Mahalingam also stated that he traditionally co-signed the financial statements with Samy Vellu, and was  surprised that the co-signatory for 2004, 2005 and 2006 was another trustee, Datuk Dr T. Marimuthu.

Even though the accounts were signed by Samy Vellu and Marimuthu, the statutory declaration requires only for the person taking responsibility for the financial statements, in this case the former.

The sources said it was peculiar that the external auditors, Kumpulan Naga, also had given their report on the same days that Samy Vellu and Marimuthu had signed the financial statements.

When contacted, Marimuthu said: "I can’t remember. It was a long time ago and I signed many documents."

Chitrakala had alerted the MACC over irregularities in the institute's financial accounts for 2004 and 2005 last week in the hope of stopping the 3-in-1 MIED annual general meeting from adopting irregular accounts and misleading members.

In a letter to the MIED company secretary, Chitrakala said: "As the CEO from May 2004 till January 2009, I know, for a fact, that the 2004 and 2005 MIED accounts were not prepared and ready for execution.

"This was because Kumpulan Naga (the external auditors) could not do the consolidation of the MIED accounts as the accounts of AIMST Sdn Bhd, one of its subsidiaries, were not ready at that time.

"I believe the accounts for the years 2004 and 2005 were intentionally backdated with a collateral motive and do not depict the true and actual accounts of MIED," she said in her letter, a copy of which was made available to The Malay Mail.

"I view these acts of MIED and its auditors Kumpulan Naga as serious and grave breaches of law, especially since MIED is the guardian and trustee of public funds and government grants."

The accounts for the three years were passed during last Monday’s meeting, much to the chagrin of several MIED members and party leaders who felt that the meeting, the first official one in 26 years, should have been put off pending investigations by the Companies Commission of Malaysia (CCM).

The CCM, which is investigating MIED for violation of eight sections under the Companies Act 1965, recorded a statement from Chitrakala last Wednesday.

CCM enforcement officers last Friday recorded a statement from former MIC Youth chief S. Vigneswaran, who launched an unprecedented derivative action against the MIED board of trustees under Section 181 of the Companies Act.

If the court rules in his favour, the MIED will become the plaintiff in the suit against the trustees for alleged financial irregularities, abuse of power and negligence.

Samy Vellu, when contacted yesterday, declined to comment.

It is good that Samy and his gang of thievies who stole from the poor Malaysian Tamils are finally being cornered. I used to work for T Nagarajan, proprietor of Kumpulan Naga and we used to backdating accounts regularly and preparing different sets of accounts for Income Tax office, banks. It seemed it ok to do those things then.

I think Chitrakala has her own agenda, and is not the angel she is protraying. This is apparently through her frequent use of the media...I think the public is wiser than this, good try chitra!

Now it is time for the MACC to see the revenues for MIED and its allies. The receipts would have gone down after the 2008 elections. Let MACC figure out who is channelling their extras through these tax exempted companies. Check out all contractors connected with malaysian road projects and AIMST projects.

Good for Chitra.Whatever, she should be supported; although eventually, it should also be explored why the 'honest' officers of MIEDS kept their silence until now. An explanation on that cannot be forgone,while trying to catch the bigger fish.If the authorities do not take seriously this apparent large scale fraud of public funds...the whole country and Judiary system will be seen as a corruptred , inefficient and not effective at all entity.It is disturbing in the MIED instances people like Samy Vellu allowed or was a cohort to outrageous miscarriages of public duty, while misleading the public.It become beyond any decency of outrage when he has appeared to have "cooked" curry of his records and actively falsified records- with the only possible intention- to MISLEAD the nation and citizens.It is irrelevent whether this body was for indians or others, the fact it is a Malaysian body and for Malaysians - should suffice;the honest and fair law of Malaysia should be thrown at Samy and his co-perpetrators .It is further more appaling someone like a Commissioner of Oaths- was a willing party to CHEAT the public yet again while knowly; that these documents do not represent what they are presented to be. The Commisoner of Oaths should be investigated by not only his body but criminally by the police and charged if the evidence is there.To what extent this thamby Samy is prepared to go to cheat the very people he claims to represent is comming to light now and it is atrociously disgraceful.He had ample chance, when the first mesage arrived that he is no longer needed, but like a bald buffon he has tried to stay on ....not wanting to let go the .....milking of funds of his own community.How more low can one get in life, if all this is now true and proven with evidence.No servent of the public should lie to the public; when that strats , it is time for that person to move on, and allow the public to chose the next.That is clean and honest politics.

I really can't believe it for a trustee commitee entrusted with billons of assets to hold their first official meeting in 26 years. Aiyo aneh, why you decline to comment when the reporter meet you. Just simply hentam lah for what you are famous for. Kalau tak hentam kemaluan saya sangat besar tahu. Kalau tidak suka tol naik kamu boleh naik kereta lembu. Kita akan buat satu jambatan di sini. Tapi Datuk, sini tidak ada sungai kenapa kita mesti buat satu jambatan. Ini macam kah. Kalau tidak ada sungai kita boleh buat satu sungai dulu dan kita buat jambatan. Banyak senang.

where do you people dig such things up from? not complaining just that i dont know where this thing with samy vellu and his "hand in everything" will end. i hope he resigns before he is subjected to more misery in his old age. if such things like you exposed cant bring the wrong doers to justice, i dont know what will.

chitrakala, fine one to make reports when she herself was party to all the wrong doings. will there be an investigation against the commissioiner of oaths by his governing body?

i am glad that these acts are being reported and being investigated by the authorities. lets hope all these will come to a quick end as it is more and more embarasing for the indians.

This is grand scale corporate fraud. MACC sent this fella to jail. 20 years jail sentence is minimum.
