Nizar's hopes snuffed out as Federal Court upholds Court of Appeal ruling

PUTRAJAYA: Datuk Seri Dr Zambry Abdul Kadir (pic) has been declared the rightful Menteri Besar of Perak.

The five-man Federal Court bench this morning retained the Court of Appeal's decision pronouncing Zambry, 47, as the lawful MB, ending any hope of his predecessor, Datuk Seri  Mohammad Nizar Jamaluddin, 52, of the Pakatan pact of DAP-PKR-PAS, reclaiming the post.

Led by Court of Appeal President Tan Sri Alauddin Mohd Sherif, the other members of the bench were Chief Judge of Malaya Tan Sri Arifin Zakaria and Federal Court judges Datuk Zulkefli Ahmad Makinudin, Datuk Wira Ghazali Mohd Yusoff and Datuk Abdull Hamid Embong.

The court compound was packed with supporters of both parties, with more than 1,000 turning up. Police personnel, including the Federal Reserve Unit, were also stationed there.

Nizar arrived at 10am, while Zambry was not present.

Nizar had challenged Zambry's appointment and succeeded at the High Court that had ruled that there was a loophole in the Perak Constitution to allow Zambry to be sworn in as MB when Nizar, being the incumbent, had not resigned.

In the decision on May 9 last year, High Court judge Abdul Aziz Rahim had ruled that the Perak Sultan did not have constitutional powers to sack Nizar, and as such, Nizar should still head the State.

Abdul Aziz had also ruled that Nizar, or any MB, can only be dismissed if the State legislative assembly put through a vote of no-confidence.

The Court of Appeal, however, overturned this decision, ruling Abdul Aziz's reading of the law as "wrong" as there was a confusion on the issue of how the MB had lost the majority confidence with the question of if the Sultan had the power to dismiss the head of government.

Nizar, who is the PAS assemblyman for Pasir Panjang, had become the MB after his party, Pas, formed an alliance with DAP and Parti Keadilan Rakyat, to hold majority stake in the State legislative assembly.

He was ousted 11 months later when four Pakatan Rakyat (PR) assemblymen left the alliance.

Bota assemblyman Datuk Nasharuddin Hashim, who had crossed over to PKR, rejoined Umno, while assemblymen for Behrang, Jamaluddin Mohd Radzi, Changkat Jering (Osman Jailu) and Jelapang (Hee Yit Foong) declared themselves as independent candidates friendly to the Barisan Nasional coalition.

Their departure left the PR coaltion with only 28 representatives in the 59-seat State assembly while BN had the same number of members, plus the support of the three Independents.

The controversy was fuelled by the Election Commission's refusal to accept the three resignation letters forwarded by the pro-PR State assembly speaker for Jamaluddin, Osman and Hee.

Nizar was granted an audience with the Sultan of Perak but failed in his effort to convince Sultan Azlan Shah to dissolve the assembly and force a fresh State election.

Nizar was told to resign and Zambry was then appointed as the new MB.

At least this Perak MB smiles alot unlike LORD Guan Eng in the Kingdom of Penangland..... PR in Perak should stop dreaming and stop play politics under a tree anymore. Behave and argue like an intelligent group of opposition. STOP leaving the assembly and turning your back on the Sultan. Grow up like a sensible new child in politics. STOP street demonstrations as your behaviour is making the people in Ipoh p****d off. On the other hand , how will voters from Perak reacts? zambry must be 100 % sure that he is indeed the MB of Perak . And that is by the good old fashion way. The ballot box.

Okay, so Dr Zambry is MB by default out of the 4 PKR assemblymen who switched allegiance. I wonder if the rakyat who voted for these 4 'ship jumpers' voted for the party or the individuals themselves. If it is the individuals, then regardless of what party they are in, they should serve the people just as well. If it was for the party, then the people in those constituents got cheated. Congrats, Dr Zambry for your back door victory. Hope you will from now lead the Silver State to greater heights. Just don't disappoint the people. Thank you.

Congrats. Dr. Zambry.Now that the political uncertainty has been solved, focus on the economic development plans and winning back the hearts of the people. Remember the people had never betrayed BN but it was because of the arrogant, rotton BN politicians and their tidak apa attitude that made the people turn against BN.

Zambry should remove all the useless and corrupted politicians and the non performign civil servants from the system.Some of them are simply a liability( eps the corrupted ones) remove them and rope in people who are keen to serve the people.There is a lot to catch up to get the silver state shining again. I believe the people are ready to give you all the support and cooperation.As for PKR and Nisar be a spot. Accept the court decision and cooperate with BN to develope the state.Be a good watchdog of the people and wait for the 13th general election.

Tahniah ! what most important heare by that court ruling its show that HRH the Sultan of Perak decision to disolve the state asembaly and appoint DR Zamry was correct and in acordence with state laws ,after the previous lost his majority. This rulling has been a good lesson to be remembered and take account of it.

The purpose of the STATE'S HIGH COURT ruling in favour of Nizam was for the DISSOLUTION of the STATE ASSEMBLY and the calling for a State Election. This was because the PR State Govt lost the majority when certain members left the Govt party. Dissolution and calling for another State Election is the normal thing to do in any Commonwealth Member country. His Royal Highness has the PEROGATIVE/RIGHT to appoint a CARETAKER GOVERNMENT until the date of the election is set by the Electoral Commission, and taken place, whereby a new State Government will be decided by the rakyat. This is how it is done if you are a member of the "British" Commonwealth. So, before the Federal (National) Court's decision, Zambry should only have been a "CARETAKER CHIEF MINISTER". I have a feeling that His Royal Highness was "ill-advised". No point in crying over spilt milk now. However, there is still a question. It is quite similar to the concept of "SEPARATION OF POWERS". THIS HAPPEN TO BE A STATE POLITICAL AFFAIR. The Highest Court in the State (assumed to be the Guardian of the State's Rakyat) had made a "Stately" decision on behalf the State's Rakyat which it deemed to be FINAL. WHY SHOULD/CAN THE FEDERAL COURT INTERFERE WITH STATE JUDICIAL AND POLITICAL AFFAIRS? You tell me!!!
