IN a new twist, part-time model Kartika Sari Dewi Shukarnor, 32, now says she wants her punishment to be carried out quickly and that she will not file an appeal.

 

Ordered to be whipped six times by the Kuantan Syariah Court, after she had pleaded guilty to consuming beer in public in Cherating, Pahang on July 11, 2007, Bernama reported that Kartika just wanted the ordeal to be over.

"I will accept this punishment, let Allah decide my punishment in the hereafter," said Kartika, who has been residing in Singapore for the last 15 years.

Based on the Syariah Criminal Procedure Enactment 2002, the whipping tool used must be a rotan or small branch that should be not more than 1.22 metres long and not more than 1.25cm thick.

The whipping has to be done using moderate force and the punisher should not raise the hands over the head to avoid injuring the skin. The appointed punisher must be a fair and mature person, During the punishment, the offender must be dressed according to Syariah law.

Male offenders will be whipped while standing whereas female offenders will be in a sitting position when whipping commences.

Whipping would not be done on pregnant offenders and would only be done two months after delivery. It must not hit the face, head, stomach, breast or private parts - only the buttocks.

The offender's health should be checked by government health officers who should also be present during whipping.

The whipping must be done at locations determined by the court or the State government. The whipping punishment is more commonly conducted at the Penor jail in Kuantan, Pahang as the officers there are trained to conduct them.

Earlier, women leaders such as Women, Family and Community Development Minister Datuk Seri Shahrizat Abdul Jalil and Titiwangsa Member of Parliament Dr Lo'Lo Datuk Mohd Ghazali had expressed concern over the harsh punishment in relation to the offence.

This is much to do about nothing. This is not a Singapore style caning where the victims bare buttocks are slashed to ribbons. She will be whipped with a shorter, more slender cane, something more akin to a switch. She will not have her bottom bared nor will she be bent over and fastened to a whipping post. She will be caned in a sitting position where he buttocks will barely be accessable to the cane. The flogger will not be allowed to raise the cane above his head so the strokes will be relatively light. Her so-called caning will be more of symbolic gesture than anything. At worse she will feel a mild sting and have a few red stripes on her bottom afterwards. I'll admit this is kind of absurd for drinking beer, but she choose to be a Muslim and she knows the rules. She broke one and now she must accept the consequences for her actions, even if it is ridiculous. She's really lucky to be getting a few licks with a switch as opposed to a jail term. And she's really lucky that's she's not getting a real caning.

It is sad to see a country aspiring to become a modern and developed status by 2020 and have sent a man into space but yet retain a medieval form of punishment. What next? Burnt them alive at the stake? Across the civilised world we want to stop domestic violence and in particular violence towards women and children. Yet an institution in Malaysia is condoning flogging a woman. It is not setting a good example and is sending the wrong message to men that it is ok to physically harm a woman.

NKZ, two of our lady politicians are crying foul over it and they are of the same religious faith. Are you going to tell them to shut up as well for not knowing and understanding their own religious laws? Fully agree with you though, that the law must be carried out if it is deemed fit regardless of sex or gender but to ask someone to shut up because they voice their concern and comments is juvenile. Life is short and let's live and learn.

Get on with it. I fully agree. Do you know what will happen? The whole world will descend on Kuantan - at least all the press, CNN, AlJazeera, CCTV, Reuters, AP, Bloomberg. That would be a circus day. Kuantan will be famous. I guess that would make Ng Yen Yen happy. One paper will pay a million buck for the story. Women all around the world will condemn Malaysia. Malaysia status will be downgraded. No brain would want to come back. Get on with it.

I happened to browse this site: http://www.insidesaudi.com/whippingwomen.html, and I quote a part "According to the strict observances of Sharia Law, whipping women is a mandatory punishment for committing a crime of morality. These mandatory punishments extend to, and include illicit sexual activities such as: extramarital affairs, alleged adultery, fornication, prostitution, consensual homosexual activities and ‘proven’ cases of rape." Note that consumption of alcohol is not listed for mandatory whipping. The justification for mandatory whipping goes like this: "Saudi Arabia, who is primarily Wahhabi, and protectors of the two holy cities, has traditionally implemented and advocated floggings. Because some influential Wahhabi Muslims believe they are holier than their Muslim brethren,(i.e. Shiite or Kurdish Muslims), and because they believe they practice the purest form of Islam, and are the protectors of Mecca and medina, they feel they are justified in their interpretations. Wahhabi are more rigid in the definition and implementation of Islamic law, customs and traditions." I have searched extensively over the internet, and could not find any case where a woman was whipped for consumption of alcohol. In sentencing, was the purpose to mete out justice? or to create an impression?

better we mind our own business. this punishment is related to their own religion. if this kind style is allowed then ill moral activities will be rampant by women. we're seeing it everywhere in the world. just my 2cents worth.

OMG is this for real? Flogging a woman for drinking beer is such an exaggurated penalty. Isn't caning is usually reserved for men in various crimes ranging from rape to bribery? Why punish a woman so severely for minding her own business? I am shocked by the backwardness of this situation. It is not doing anyone justice. She didn't harm anybody so leave her alone. I'm glad we're making international headlines with this kind of nonsense. Come on! I love my country and the advances it has made but it seems like there's a lot more work to be done regarding mental attitude. A little forgiveness perhaps?

Islamic laws apply to all regardless of female or male... If you are not a Muslim and don't understand Muslim laws, just keep your mouth shut because non of the Muslim ever condemn other religious faith or punishment...

"because non of the Muslim ever condemn other religious faith or punishment..." Muslims necessarily condemn polytheism, or shirk. The Koran has lots of condemnation for unbelievers. And a lot of the unbelievers know that. If anyone wants an English-language relatively complete guide to Islamic law, I recommend the book Reliance of the Traveller, by Ahmad Ibn Naqib al-Misri. It's endorsed by Al Azhar University, saying that it "conforms to the practice and faith of the orthodox Sunni community." It's not sanitised for Western eyes - it gives the real deal, direct from several of the top Islamic scholars. And it does list the punishment for drinking, which is actually 40 lashes, not 6.
